Settlement Agreement Solicitors: Clear Advice When the Working Relationship Comes to an End

Our settlement agreement solicitors can advise you when the relationship between an employer and employee breaks down. A formal settlement agreement can help both parties reach a clean and legally binding resolution.

At Sewell Mullings Logie, our Employment Team has extensive experience advising on all aspects of settlement agreements, including drafting, negotiation, and final settlement terms.

Why Legal Advice Is Essential

Settlement agreements are legally complex documents. They often involve:

  • Termination payments
  • Waivers of legal claims
  • Confidentiality clauses
  • Post-termination restrictions

While employers may provide a list of recommended solicitors, it’s important to choose a legal advisor with experience in employment law and an understanding of your specific rights and interests.

How We Help

  • We explain your legal rights and the implications of signing the agreement
  • We negotiate terms where appropriate to improve your position
  • We ensure you receive the best possible outcome, both financially and professionally

Our aim is to support you through what is often a difficult time, with clear, practical, and confidential advice tailored to your circumstances.

What Is a Settlement Agreement?

A settlement agreement (previously known as a compromise agreement) is a legally binding contract between an employer and an employee. In exchange for a financial payment and other benefits, the employee agrees to waive any potential employment tribunal claims they may have against the employer.

Independent Legal Advice Requirement

For a settlement agreement to be legally valid, you must receive independent legal advice from a qualified solicitor. Our settlement agreement solicitors will review the terms of the agreement, advise you on your rights, and ensure you fully understand the implications before you sign. Importantly, in most cases the employer will contribute towards your legal fees.

What We Advise On

Our settlement agreement solicitors advise on all aspects of the agreement, including: the amount of the termination payment and whether it is fair, confidentiality clauses and non-disparagement obligations, post-termination restrictions such as non-compete or non-solicitation clauses, reference letters, and any impact on benefits such as pension or share options.

For more information about employment law for employees, see our advice for employees page. The GOV.UK guidance on settlement agreements also provides useful background information.

If you have been offered a settlement agreement, please contact our Employment Team as soon as possible. We offer quick turnaround appointments and will ensure you have the advice you need to make an informed decision. Call us on 01285 650000 or use our online contact form.
