Property Sales & Purchases

We provide a bespoke, practical and efficient service to commercial and private clients in purchasing and selling business premises and take time to understand the needs of our clients’ business.

We have a team of dedicated property solicitors with extensive expertise in all aspects of buying and selling commercial property. We keep clients informed at every stage.

We acted for tenants of a leasehold commercial property in the sale of the lease. The property was a listed building and was at the time of the sale being used as a tea shop/restaurant.  The buyer was concerned that the property might not have full planning consents for this use, so the contract was made conditional upon obtaining a certificate of lawful development and planning permission and listed building consent for the works the buyer wanted to carry out.

The buyer wanted the planning consents to be satisfactory to it but our clients did not want the buyer to have the right to rescind the contract on a whim.  The team therefore added conditions to the contract to define clearly what were to be regarded as satisfactory planning consents, such as one that did not restrict opening hours or materially affect the cost of carrying out the works for the buyer.

The buyer obtained the planning consents, these complied with the conditions in the contract and the sale was completed successfully.
